Who can propose a Debt Agreement

You can lodge a Debt Agreement proposal if you:


Have paid the government lodgement fee in full or have an arrangement with ITSA about payment in arrears.

Are insolvent (unable to pay your debts as and when they fall due).

Have not been bankrupt, had a debt agreement or given an authority under Part X of the Bankruptcy Act in the last 10 years.

Have unsecured debts, assets and after tax income for the next 12 months all less than set limits. (Limits listed below).

  • After tax income of less than $70,898.10 per year which is about $1,363.00 in the hand per week;
  • Unsecured debts of less than $94,530.80;
  • Property that would be divisible among creditors if the debtor were bankrupt valued at less than $94,530.80.
